GDPR and ICO

From 1 January 2021, the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018 became the UK law governing the processing of personal data. The UK GDPR gives individuals more control and rights over the processing of their personal data. In addition, it introduces more accountability on data controllers like Zero Tech Waste Ltd to demonstrate compliance with data protection law. At Zero Tech Waste Ltd, our systems and processes are compliant with UK GDPR.

Some of the highlights in UK GDPR are as follows:

All personal data must be processed lawfully, fairly and transparently. It must be collected for a specific and lawful purpose, limited to what is necessary to fulfil the purpose, kept accurate and for no longer in time than is necessary as well as processed in a secure way. Zero Tech Waste Ltd must be able to demonstrate compliance with these principles.

Greater safeguards exist when processing ‘special category’ personal data. This includes data relating to health, religion, race, sexual orientation, genetics and biometrics.

Zero Tech Waste must ensure data protection ‘by design’ and ‘by default’. This means it must ensure there are appropriate technical and organisational controls in place to process personal data securely.

Zero Tech Waste must notify the regulator, the Information Commissioners Office (ICO), of any data protection breach 72 hours, at the latest, after becoming aware of it unless it does not pose a risk to the rights and freedoms of the individuals concerned.

Fines that can be imposed for data protection breaches have increased up to, in some cases, 4% of annual turnover or €20 million (whichever is greater).

Information we are likely to hold

  • Provided by you as part of a submission of a form on this website, for example via the Book Now page, or the customer satisfaction survey page.
  • Personal information provided to us via email communications. Including, but not limited to, email/phone number/name/business address/gender
  • Specific access information to your site or place of business, if provided to us via email

How your data is stored

We take a robust approach to protecting your information with secure electronic and physical storage areas for data with controlled access. Access to your personal data is strictly controlled on a need-to-know basis and data is stored and transmitted securely using methods such as encryption and access controls for physical records where appropriate.

Alongside these technical measures there are comprehensive and effective policies and processes in place to ensure that those who process your personal information are aware of their obligations and responsibilities for the data they have access to.

By default, people are only granted access to the information they require to perform their duties. Mandatory data protection and information security training is provided to staff and expert advice available if needed.

We may disclose your personal information if required by law for example to comply with a court order.

Your rights and how to exercise them

The rights include:

  • the right to access to their personal data (eg via a subject access request, free of charge to be dealt with within one month of request)
  • the right to rectification of inaccurate personal data
  • the right to data portability (ie made available in a portable format in order to move it from one controller to another)
  • the right to erasure (ie deletion of personal data)
  • the right to object to processing
  • the right to restrict processing and
  • rights in relation to automated decision-making, including profiling.
